Pursuant to your oos t recent Order concerning construction defects and imprcper use of materials at Marble Hill, Save The Valley (STV) wishes to stato that a suspension of cons;ruction should continue indefinitely.

It is ou opinion that your Order is entirely too confining and does not allow for reasonable direct and cross-exanination of any and all investigators who have been allowed on site, at Ma"ble Hill - Eindly note that STV on or about June 6, 1979, requested

- anindependent engincer be allowed on site for the pu pose of reasonabl discovery. Either the N.R.C. has denied our request for name or simply has nc: responded.

It is ou- intention to closely watch the movements o f the H. R .C .

Subject:

ALLEGED COVER-UP OF NONCONFOIO!ING CONCRETE CONSOLIDATION REPAIR DEFICIENCIES On June 12, 1979, RIII was informed by the licensee's QA Manager of the following allegations and related events:

1. On the morning of June 12, 1979, a local TV statica (Channel 2, WAVE, Louisville, Kentucky) requested "on-camera" interview with the licensce's QA organization and the site concrete contractor's QA organization
2. During this plant site interview, the licensee was informed that a 24 page legal deposition had been filed with the Jefferson County Court House by a local intervening group (Save the Valley) in behalf of a site concrete cra f tsman. This deposition is believed, but not known to be, the basis of a suit. This deposition reportedly describes collusion between the licensee's QA organization and the site concrete contractor's QA organization for the purpose of either " covering up" or misrepresenting nonconforming concrete repairs on the containment and steam tunnel structures.
3. One page of this docuT.ent was given to the licensee during the t. i c interview. The licensee is attempting to obtain a full copy.

Further inquiry and investigation by RITI is planned.

The licensee has made a press release. The state of Indiana will be notified.

This PN is being issued because of anticipated videspread publicity.

Region III (Chicago) received notification of thi: matter at 3:15 p.m. on June 7, 1979.

ALLEGED COVER-UP OF NONCONFOR'!ING CCNCRETE CONSOLIDATION REPAIR DEFICIENCIES - UPDATE As reported in PNC-79-155, allegations have been made that there was collusion between the licensce's QA staff and a site contractor to conceal non-conforming concrete repairs. On June 21, 1979, the licensee reported to Region III that an investigation had identified several instances of improper repair of poorly consolidated concrete.

The allegations were phrased in general terms, and Region III has been attempting to contact the alleger to obtain more specific infornatio1. To date the alleger has refused to cunmunicate with Re2 i on III except through counsel. Region III has sent inspectors to the site.

Local media interest has been high.

ALLEGED COVER-UP OF NONCONFORNING CONCRETE CONSOLIDATION REPAIR DEFICIENCIES - UPDATE (REF PNO-79-182)

As previously reported it has been alleged that certain repairs of concrete honeycombing (misconsolidation) were in nonconformance with site QA/QC require-ments.

As a result of RIII inspection activities relative to concrete place-ment and consolidation, the following has occurred:

1.

A management meetirg was held at the site on June 25, 1979, and an Immediate Action Letter (IAL) was issued outlining corrective actions that the licensee must take relative to concrete activities. The principal provi-sion of the IAL was to stop safety releted concrete activities until certain corrective actions had been taken.

2. RIII is currently evaluating the licensee's response to this IAL. Those provisions relative to the placement of safety relatad concrete have been resolved to the extent that RIII and the licensee have released the stop work on these concrete activities. Other provisions of the IAL relative to the licensee's activities arc. being evaluated by Region III.
3. The alleger identified in PNO-79-182 was contacted by RIII, provided transportation frcm his residence in Texas and participated in RIII investigative activities at the site on July 7, 1979. His allegations with respect to improper concrete repairs were substant'ially confirmed.

Investigation into the extent of the licensees and contractors knowledge of these deficient conditions prior to the allegations and investigation is continuing.

On July 7, 1979 and July 9, 1979 three additional allegations were provided to RIII by the Attorney -for a local intervening group (Save The Valley). Three separate individuals provided these allegations. All three of these new allegations involve concrete placement and repair of honeycomo' conditions. y p

These matters will be reviewed during Region III's onCoing investigation.

SUBJECT:

RECURRING CONCRETE PLACEMENT DEFICIENCIES On July 20, 1979, the Region III Director and members of his staff met with members of Public Service of Indiana corporate management to discuss the concrete placement activities at the Marble Hill nuclear site. The mec ting was prompted by Region III inspection findings wherein quality control deficiencies continue to exist in connection with placement of Class I concrete. (Concrete placement activities had previously been stopped by the licensee last month for about 10 c'a y s as a result of similar problems - Reference PNO 79-132A.) As a result of the meeting, PSI has stopped further Class I concrete work pending evaluation of its contractor's corrective actions as well as its own overview of con:truction activities. NRC's position on this matter will be based on the licensee's proposed action.

The State of Indiana is being kept abreast of developments.

The licensee has issued a press release and Region III is responding to news media inquiries.

CONSTRUCTION DEFICIENCIES NOTED BY ASME INSPECTORS Region III learned on July 24, 1979, and later confirmed with the licensee that in a letter dated July 10, 1979, an inspection team of the National Board of Boiler and Pressure Vessel Inspectors had recommended that the ASME certifi-cate issued to Public Service of Indiana be suspended pending correction of a number of code violations identified in a site inspection on June 12-14, 1979.

The subject was on the agenda of the cognizant ASME Committee which met on July 23-24, 197S, in Chicago. Consideration of this matter was deferred to a scheduled September meeting.

Region III will have an investigation team on site beginning this week to deter.aine the extent of the code violations, the relationship of these to the site QA-QC program and whether that program is functioning properly and can function properly in the future.

Considerable news media attention is expected.

The State of Indiana is being kept informed of developments.

STOP WORK ORDER ISSUED TO AMERICAN BRIDGE AND IRON COMPANY Region III learned on July 31, 1979, that Newberg Construction Company had issued a stop work order to American Bridge and Iron Company following unautho,-ized modifications involving the attachment of clip angles to structural beams. While the number of instances known are considered minimal, clip angles were being welded instead of bolted.

Considerable news media attention continues to be given to the construction problems at Marble Hill.

The State of Indiana is being kept informed.

Region III was informed of this action by the Public Service cf Indiana Construction Project Engineer.

SuMect_: STCPPAGE OF ALL SAFETY RELATED WORK On Atgust 6, 1979, Region III was informed by licensec corporate management that PSI w.uld be holding a news conference at 10:00 a.m. (est) on August 7, 1979, a norncing that all safety related work at. Marble Hill was being stopped and that work would not be resumed until the controls for that work had been upgrade. to the satirfaction of PSI and the NRC. Concrete safety related work had been v orped earlier. The decision to stop other safety related work was based on NRC inspectica lindings and iSI audit findings of the manage-ment controls governing otacc reas of the job.

Based on an NRC inspection completed on August 3, 1979, NRC agrees that the staffing and controls associated wit'a the Marble Hill project need to be upgraded. Further action is under cons' den tion The State of Indiana will be informed by NRC just prior to the news conference.

The delay in the proj ect is unknown at this time bct it is expected that some of the work could be significantly delayed.

Region III was informed of the licensee's decision tc stop work and hold a news conference at 12.30 p.m. on August 6, 1979.

LICENSEE - NRC RIII MANAGEMENT MEETING CONCERNING "0RDER CONFIRMING SUSPENSION OF CCNETRUCTION" DATED AUGUST 15, 1979 On August 15, 1979 the Region III staff conducted a management meeting at the Region III office with Mr. S. W. Shields, Vice President - Electric System and other staff members of Public Service of Indiana.

The purpose of this meeting was to: (1) assure that the context of the

" order" suspending construction was fully understood by PSI; (2) confirm the licensee understood the needed corrective actions; (3) establish mutual accord relative to the handling of vendor s"oplied safety related materials and site receipt of same, and (4) discuss the ramifications of adverse findings documented in the National Board of Boiler and Pressure Vessel Inspector's inspection report dated July 10, 1979.

The immediate resolutions of this meeting were as follows:

1. The licensee may continue to nondestructively test and evaluate existing concrete to determine its adequacy.

2.

The licensee may continue the process of removing all existing concrete patches. However, this activity can be conducted only after notification of an NRC inspector for each concrete patch.

3.

The licensee may continue to accept on site and account for (number and damage) vendor supplied materials, vessels and components. How-ever, all such materials, components or vessels are to be placed on immeoiate " HOLD", stored, and properly protected.

4. The reactor vessel or vessel internals may not be handled or received at the site without prior notification of NRC RIII.

During this meeting the licensee acknowledged understanding of the issues outlined in the order and the elaborations provided by NRC RIII staff.

ADDITIONAL ALLEGATION 5 PROVIDED Tu NEWS MEDIA RELATED TO U.S. TESTING COMPANY News media in the vicinity of the Marble Hill construction site have reported that Rap. Joel Deckard has obtained a sworn statement from an inspector for the U.S. Testing Company at the Marble Hill site which alleges that in at least one instance a report he prepared was changed and his signature falsified.

Rep. Deckard reported he planned to submit this infornation to the Department of Justice.

U.S. Testing Company is contracted by Public Service of Indiana for various testing activities including testing associated with concrete placement and reinforcing steel bar strength.

The alleger is also reported by the news redia to have told Rep. Deckard that:

(1) Curing temperatures were recorded on days when no inspector was present, (2) concrete samples were placed on ice to change their temperature and (3) he had been instructed by his superiors to select the best batches of concrete to use for preparation of testing samples.

Rep. Deckard earlier intorned the NRC of the general nature of allegations he had received in the area of the U.S. Testing Company progran Because of the earlier allegations Region III contacted the U.S. Corps of Engineers to conduct an inspection of U.S. Testing activities at the Marble Hili site. Congressman Deckard has not provided the NRC staff with the details of his original allega-tions.

Region III (Chicago) received an initial news media inquiry regarding these latest allegations at 4:45 p.m. August 20, 1979. Further details were supplied by a reporter on August 21, 1979. -

The State of Indiana will be informed.

SUPPLEMENTAL INFORMATION ON ALLEGATIONS RELATIVE TO U.S. TESTING CCMPANY On August 23, 1979, at 10:28 a.m., a former employee of the U.S. Testing Company (not the individual who had contacted Rep. Deckard) at the Marble Hill site contacted a RIII Investigation Specialist. Contact had been made with this individual during a recent investigation. He stated that he had read of the allegations relayed by Representative Joel Deckard in his local newspaper that morning. The former employee indicated that tne allegations are basically true, but he felt that they did not have signif-icance when the whole story was understood.

Region III is pursuing this matter with the former employee to obtain more detailed information.

News media interest is continuing.
