On August '.4,1979 the fluclear Regulatory Commission submitted a statement on the c rnission actions being taken with regard to the recommendations o

made by the Comptroller General of the. United States in a report entitled,

"':igher Penalties Could Deter Violations of fluclear Regulations." The Commission's resp:nse.o the GA0 report inadvertently omitted the following cc~.ments which should be included as part of the Commission's comments to the GA0 report of February 16, 1979.

"The :iRC has recently appointed a new Director for the Office of Inspection ar.d Enforcement who is currently reassessing I&E's enforcemen. crganization, policies, and procedures.

In addit:'n, the Commissicn has requested Congressional authorization to increase its civil penalty authority from $5,000 per event to

.51C3,00u per event.

In anticipation of positive Cengressior.al action on this request, the staff is presentl." preparing procedures for Cor:missien approval to implement the higher civil penalty authcrity.

This staff effort is expected to be completed by January of 1930.

As a result of these reviews, we anticipate additional changes in our enforcement policy.

In addition, we believe these actions are responsive to the concerns raised by GA0 in their report on higher civil penalty authority."

Comissioners Bracford and Gilinsky believe that the detailed response to the GA0 recommendations should have awaited completion of the above actions.
