Dear Mr. Nader:
This is in response to your letter of November 30, 1975, in which you asked whether the upgraded security regulations expected this winter for nuclear power reactors will ".... require that reactors under construction at multi-unit stations maintain the same security regulations as operating reactors, unless the licensee can demonstrate that access to an operating reactor cannot be gained from a reactor construction site."
In answer to your question, compliance with physical protection regulations proposed in November 1974 by the ItEC (10 CFR Part 73 fi73. 55) and now being considered for publication in effective form by the NRC would be expected to achieve the same level of security at all operating nuclear power reactors, whether or not on a site at which construction is in progress for additional power reactors.
The security review plan for operating reactors with construction activities on the site is now and will continue to be performed on a case by case basis to assure that any interim protection measures associated with construction activities are as effective as permanent protection measures installed in compliance with URC licenso conditions.
As we have stated previously, we consider adequate physical security to be a natter of continuing high priority.
