Dear Mr. Robichaux:
This is in further response to your letter dated August 30,1979 in which you requested, pursuant to the Freedom of Information Act, documents relating to allegations regarding the falsification of documents by Southwest Research Institute of San Antonio, Texas.
As I indicated in my letter dated October 11, 1979, portions of document 9 were ;eferred to the Federal Bureau of Investigation (FBI) for a disclosure determination. We have been informed by the FBI that certain information on pages 1 and 5 of this document should be withheld pursuant to Exemption (7)(C) of the Freedom of Information Act (5 U.S.C. 552(b)(7)(C))
since disclosure would constitute an unwarranted invasion of personal privacy.
Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt frcm production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Mr. David G. Flanders, Chief, Freedom of Information-Privacy Acts Branch, Federal Bureau of Investigation.
This denial may be appealed to the Commission's Executive Director for Operations withS 30 days from the receipt of this letter.
As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial FOIA Decision."
Also, as I stated in my October 11, 1979 letter, it is NRC's policy to place documents which have been released as a result of Freedom of Information Act requests in our Public Document Room (PDR) in Washington, DC.
In a conversation with Mr. Sinkin on October 26,1979, it was a

m agreed that unless I heard from Mr. Sinkin by October 29, 1979, the documents subject to this request would be placed in the PDR. Since I have not heard, this action is now being taken.
