Dr. MJ Stanley Livingston Chapel Hill, North Carolina 27514 1005 Calle Largo Santa Fe, New Mexico 87501 In the Matter of Metropolitan Edison Compan et al. (Three Mile Island Station, Unit 1) y, Dockat No. 50-289 Gentlemen:

On September 18, 1973, Mr. Lawrence Sager, counsel for the Intervenors, wrote Mr. fiaskins a letter requesting that the Intervenors be allowed to amend " Revised Contention 7" which has already been allowed as an issue in this proceeding by the Board in its Order of September 13, 1973.

The Regulatory Staff (Staff) discussed this matter with Mr.

Sager on August 29, 1973, and advised him at that time that the Staff probably would not object to such a request by the Intervenor.

The Staff understands that the Intervenors seek to withdraw from further consideration those portions of Contention 7 which concern

" Cryogenic Radioactive Waste (Gas) Treatment System" and a Higher Stack for Release of Radioactive Gases."

The Staff further under-stands that Intervenors still desire to pursue that portion of Contention 7 concerning treatment by charcoal filter of the main condenser air ejector discharge, and that Intervenors seek to add in Contention a new consideration related to treatment of the reactor

/

building containment atmosphere by a charcoal filter kidney system.

On the basis of the above understanding, the Staff does not object to Intervenors' requested amendment to " Revised Contention 7."

Sincerely,

,,,,e Douglas
