MOTION FOR APPROVAL OF STIPULATION OF COUNSEL BY THE ATOMIC SAFETY AND LICENSING BOARD On or about August 28, 1973, Counsel for the Applicant and Counsel for the Intervenor in the above captioned proceeding signed a Stipulation agreeing to the withdrawal of certain contentions subject to reinstatement upon a favorable outcome of Intervenor's appeal presently pending before the Third Circuit of the United States Court of Appeals.
On August 31, 1973, Counsel for the AEC Regulatory Staff signed the Stipulation.
Wherefore, the Staff moves for acceptance and approval of the aforementioned Stipulation by the Atomic Safety and Licensing Board in this proceeding.
