Motion For Reschedulina of Prehearing Ccnference By The AEC Regulatory Staff 1.

On August 15, 1973, the Atomic Safety and Licensing Board (ASLB) in the above cited case issued a flotice of Prehearing Conference.

tiotice set down August 28, 1973, for the next prehearing conference.

On August 14, 1973, Counsel for the AEC Regulatory Staff (Staff) was advised by counsel for the Applicant and counsel for the Intervenors that they had been consulted by the Board Chainnan regarding an appro-priate date for a prehearing conference.

Staff Counsel was not con-I l

sulted by the Board Chairman prior to his setting the date for the l

prehearing conference.

Staff Counsel Olson and Wilchins, the only Staff Counsel presently assigned to this case, have previous ccmmitments on the date of the proposed prehearing conference.

No other Staff Counsel are presently familiar with this proceeding and, because of the heavy press of work in connection with other proceedings, none can be made available to prepare for this prehearing conference.

In our view, it is essential that knowledgeable Staff Counsel be present at any prehearing confer-ence to assure the effective representation of the staff.

Counsel for the Staff has consulted the other parties and has found them to be amenable to a change of date for the prehearing conference to August 30, 1973.

5.

Accordingly, Staff moves that the date for the prehearing conference in the captioned proceeding now scheduled for August 28', 1973, b e rescheduled for August 30, 1973. As an alternative, in the event that August 30, 1973, is not a convenient date for members of the ASLB, we would suggest a conference call among the parties and the Chairman of the ASLB to establish a mutually satisfactory date for the prehearing conference.
