MDDRANDUM GPIN3DN AND ORDER DENYING IOSTIONH4Efff 0F HEARING 1.
This proceeding is scheduled for prehearing conference and for hearing on March 29 and April 10, 1968. - Those dates were fixed, upon and in accordance with the Applicant's motion for postponement' and the answer of the AEC Regulatory Staff (Staff) stating its " con-sent", by this Board's Order and Notice dated February 16, 1968 and published at 33 Federal Register 3084. Other procedural matters relating to public participation vere set out in that order which is incorporated by reference herein. This order denies requested changes in the published order.
2.
Now under consideration are a motion for postponement of the hearing filed by the Staff on March 12, 1968 and the Applicant's Answer filed March 13 The motion seeks to delay the hearing until April 25, 1968 and to extend to that date the time for filing petitions to intervene.
It is stated that the Staff needs -additional time (until "approximately April 16,1968") to complete its safety eval-1584 104 7911080hff

i untion of two application amendments, submitted on February 26 and March 6, 1968, which relate to the proximity of the facility site to Olmsted State Airport. The motion states that the Staff's report on all safety-related subjects except the airport matter vill be H
issued "within the next few days, the airport subject will be con-sidered in a supplementing. addendum projected for April 16, 1968.
The Applicant's answer, " consenting" to the requested postponement but urging that the hearing date be not later than April 25, 1968, states that its prepared testimony on all relevant hearing issues except the airport matter will be filed on March 19, 1968 and that the excepted matter vill be discussed in supplemental prepared testimony to be filed on "apprmHmately April 15, 1968."
3 consideration of the parties' uncontroverted statements as su:::marized above leads the Board to conclude that good cause for now again unsettling and undertaking to restabilize the hearing date has not been shown. Incking at this time adequate justifications for the estimated durations of the projected supplemental efforts by Staff and Applicant, the Board concludes that the motion for postpone-ment should be denied without prejudice to a reconsideration of this ruling if that is sou6ht and warranted by such facts and arguments as the parties may advance either in writing or orally at the Pre-hearing Conference on March 29, 1968.
IT IS OEDERED this 15th day of March 1968, pursuant to Section 7(b) of the Mministrative Procedure Act and to Sections 2 721(c),
y The Report was filed today.
