Your letter of Februarf 16, 1968 expressed the interest of the Dauphin County Cc=missioners in the proposed Three Mile Island Nuclear Power Station about which your Board has received voluminous-docu=cntaticn during the year. Your request that a representative of the Atomic Energy Co==1ssion explain the significance of the pro-posed plan is tncmitted, by copics of your letter and of this reply, for consideration by the Director of Regulation. I hope you vill. understand the reasons for this referral which are briefly su==arized below.

The Atenic Safety and Licensing Board in this proceeding per-foms, for the Atomic Energy C-ission and under the governing Federal laws and rules, the function of conducting prehearing con-ferences and hearings and of issuing an initial decision upon the application by Metropoliten Edison Cc=pany for a provisional con-struction pemit for the projected facility. Under the Atenic Energy Act and the Administrative Procedure Act, and the Caission's Iules 'in confomity with these statutes, our role is to conduct for-mal public proceedings and to exercise our decisional responsibility on the basis of the record so made.

It appears to be consistent with these adjudicatorf obligations that, except in the course of the duly notified public proceedings, we should refrain frc= express-ing opinions or making state =ents about the applicant's proposal.

The Cc= mission's Regulatorf Staff, under the Director of Regulation, has extensive responsibilities in licensing atonic power plants.

I am confident that your vish for more understand.ing of the proposed Three Mile Island plant vill evoke helpful info =ation frca the Director of Regulation. Moreover, you or your representative are invited to attend the prehearing conference on March 29 to pre-sent such questions about the project as may rc=ain unansvered. The Ata=ic Safety and Licensing Board and the parties yill then endeavor to further the important objective of enlarging the public's under-standing of the substantive and procedural steps through which the 1584 047 5911080 #C,g G
