License fee for Vermont Yankee Proposed Change No. 84 The purpose of this letter is to forward to you a check in the amount of $2,800.00 for the licensing review of Vermont Yankee Proposed Change No. 84.
This change modifies tables 4.7.2.a and 4.7.2.b of the technical specifications to ensure that certain valves will be subject to Appendix J, Type C leakage tests as a result of a control rod hydraulic return line modification. The original submittal for this proposal was mailed October 5, 1979, with a check in the amount of $1,200.00. The total amount of payments to date for this license review is $4,000.00.
Vermont Yankee Nuclear Power Corporation believes that the NRC revised fee schedule is illegal. We are aware that an appeal of the decision of the United States Court of Appeals for the Fifth Circuit is being considered and therefore submit the enclosed fee under protest without waiving our right to contest the validity of this fee or the entire NRC fee schedule, and without waiving any right to recover, in whole or in part, all fees paid or to be paid under the invalid fee schedule.
This fee was requested today in a conversation I had with a member of your staff. Should you have any questions in regard to this matter, please contact us immediately.
