- %'e 'rOY (Three Mile Island Nuclear Station, Unit No. 1) f cu MEMORANDUM On or before September 24, 1979 the Board will issue a memorandum and order which will rule on whether each petition for leave to intervene under 10 CFR 92.714 meets the pre-

liminary requirements pertaining to petitioners' standing to intervene under $2.714(a)(2).
The memorandum and order will also set a special prehearing conference as called for in the Commission's Order and Notice of Hearing of August 9, 1979 and it will establish a schedule for other prehearing acti-vities.
The purpose of today's memorandum is to infcrm the parties and petitioners of the Boara's intentions and the tentative schedule in order to afford the maximum opportunity to prepare.
The following is the tentative schedule for near-term prehearing activities:

u No later than Petitioners for leave to intervene will October 5, 1979:*
provide the licensee and NRC Staff with draft contentions each seeks to have litigated in the hearing.
Copies of draft contentions are to be filed with the Board.
The licensee and NRC Staff shall initiate negotiations with petitioners on the form and suitability of contentions.
Participation in the negotiations by all intervention petitioners will be required.
No later than Petitioners may amend petitions for October 22:*
1 eave to intervene and each shall file supplements to petitions for leave to intervene listing contentions in final ~
form.
(Section 2.714(a)(3) and (b)).
Interested state and government agencies will report on the subject matters on which each wishes to participate.
No later than Licensee and Staff shall deliver to the October 31:
Board answers to amended and supplemental petitions and contentions.
Beginning Special prehearing conference begins in November 8:
vicinity of Three Mile Island.
All

parties, and petitioners or their counsel, will be required to attend.
The Board has set aside November 8 and 9th as the session to consider petitions, contentions and matters pertaining to parties and petitioners.
November 15, 16 A session of the prehearing conference and 17:
set aside for public participation.
- October 5 and 22 were recommended for draf t and final con-tentions respectively by the NRC Staff in its motion of Septacber 17, 1979 and these dates were agreed to by the licensee and several petitioners.
Since these dates are consistent with the schedule proposed by the Commission and are in line with our own thoughts, we are adopting them on our motion.

7 As noted this schedule is tentative and could change depending upon unforseen developments and the availability of conference space.
However the final schedule will closely follow this one and petitioners are urged to begin preparing their contentions if they have not already done so.
Specifics will be set forth in the forthcoming memorandum and order.
