I, Frank W. Ostrander, Jr., attorney for the Energy Facility Siting Council and th'e Department of Energy of the State of Oregon, being first duly sworn, provide the follow-ing information with regard to the State of Oregon's motion for an extension of time in which to reply to licensee's Motion for Summary Disposition of certain of the contentions of intervenors CFSP and CI:
(1)
The State of Oregon served interrogatories on the NRC staff and the licensee on August 27, 1979, the reply to which is not due until September 11, 1979, and has received no reply as of this date.
(2)
The State of Oregon was informed on September 7, 1979 that the staff SER would not be issued as it had been expected to be on that date.

Without the information hopefully contained in the licensee's and NRC staff's replies to its interrogatories and in the staff SER, it is extremely difficult if not

impossible for Oregon to evaluate and determine a position on licensee's Motion for Summary Disposition within the time normally allowed by 10 CFR 2.749(a).
