Note to:

A. Schwencer Hearing Status For Three Mile Island Unit 1 On July 11, 1973, the staff and the applicant met with the intervenors' attorney to discuss their contentions and assist the intervenors in r.aking their contentions fewer in number and more specific. Of the orignial 73 contentions, the intervenors intend to pursue only f -10 unless the federal court grants their request for technical and finan-cial aid. They enumerated 10 contentions of greatest cover:

1.

The Ginna Effect (Fuel Densification)

The question whether all state-of-the-art precautions will be taken before operation to ensure that the "Ginna Effect" will not occur. They also question whether appropriate monitoring will be perfonned.

2.

Aircraft Impact They question and probability analysis and whether the contain-ment is adequate to withstand impact with respect to design and quality of constnJction. They question the effect of the cooling tower plumes on aircraft navigation and a possible risk of crash.

3.

Sabotage They qcestion whether proper watchmen and overall protection are to be provided. They are concerned about sabotage of shipnents of radioactive materials.

(The intervenors do not have the Industrial Security Plan. They were assured that it satisfies Regulatory Guide 1.17; they will be furnished a copy of the Guide.)

4.

Evacuation Plans The intervenors question whether adequate plans and procedures exist. They want to know what the plans and procedures contain contain with respect to:

Transportation in Site Environs This is a question of environmental concerns. They are concerned about the proposed routes of shipment and means of considering changes in route selection.

Cooling Tower Thermal Effects They are concerned about minimizing fogging and adverse environ-mental effects such as icing, discharges to the river minimizin:

water consumption and themal gradients, and the chlorination problem.

Low Level Radiation They contend that the plant doesn't meet ALAP= 5 mrem for the child's thyroid.

(They are being given copies of Reaulatory Guide 1.42.) They are concerned that anticipated transients t.re not adequately considered with respect to:

Monitoring internal inventory changes; b.

Monitoring and reporting releases; c.

Fuel failures; d.

Abnomal transients of pipes, valves, and pumps which

~ can lead to leakage; and Changes in fuel design such as higher enrichment. They e.

want fuel enrichment limits in the Technical Specifica-tions.

Flooding They question whether the dikes are strong and sufficient and whether there is adequate overall protection.

9.

Containment They are concerned about the quality of the concrete pouring and AEC acceptance of repairs.

10. Cost Benefit Analysis They question the 801; capacity factor and consideration of:

Hidden government costs such as Price Anderson; b.

Water costs; d

These contentions, as presented by the intervenors, were div.ussed in length and they expect to redraft them in the near future and make them available to us far coment. Another prehearing conference is expected the week of August 13th and a hearing start in September or October is likely.
