NRC STAFF'S RESPONSE TO JOHN F. DOHERTY'S MOTION FOR STAFF-PETITIONER AND STAFF INTERVENOR INFORMAL CONFERENCES TO CLARIFY CONTENTIONS The NRC Staff (Staff) opposes John F. Doherty's August 30, 1979 Motion requesting I
that this Board order the Staff to meet with intervenors and petitioners in this proceeding to negotiate regarding the contentions which have been or may be sub-mitted by these individuals to the Board. The Staff believes that there may well be a threshold question regarding the Board's authority to order the Staff to negotiate its position concerning contentions with the petitioners or other parties to the proceeding. How ever, we note that the Staff has always, in the past, attempted to accomodate reasonable requests for such negotiations by petitioners or parties to Comission proceedings.
Further, in those circumstances where we believe that such negotiations are worthwhile and would expedite the proceeding, we have ourselves initiated such negotiations.

and cuantity of issues which will be raised.
We, therefore, do not know at this time whether a negotiating session with some or all of the people 1134 355 i

. involved in this proceeding would be fruitful. However, we should make several observations which bear on the viability of an infomal conference such as the one which Mr. Doherty suggests.
First, this particular proceeding presents rather special circumstances, in no prior Comission proceeding have there been as many potential parties.
Given this situation, the Staff certainly does not believe that it would be useful for it to attempt to negotiate with 60 different people having 60 different points of view prior to the October 15,1979 pre-hearing conference Taking the time to adequately prepare and conduct such an infomal meeting might well compromise the Staff's ability to submit its written responses to the proffered contentions by October 9,1979, in the event that the negotiations were unsuccessful.
Informal discussions could, however, be fruitful under the following circumstances.
If the new petitioners could (1) agree on one or two spokesmen for the entire group, and (2) jointly agree on a list of issues in which all are interested and on which they would all be willing to consolidate, the Staff believes that a negotiating session might well expedite this proceeding. We would be happy to participate in such a session prior to tie prehearing conference scheduled for October 15. Should such an infomal negotiating session be scheduled, the Staff would also be

more than willing (either prior or subsequent to the meeting) to answer any general questions which the petitioners have concerning either substantive or procedural aspects of Cornission adjudicatory hearings.
Since most of the petitioners appear to reside in proximity to each other, it is not unreasonable for them to meet, prior to any negotiating session, i

_3 to attempt to reach agreement amongst themselves on the issues they wish to raise. Should such an agreement be reached among the pet'itioners, and should they then be interested in an infonnal meeting with the Staff, a spokesman for the group may reach the undersigned either by phone at 301-492-7268, or by mail at the following address:
