50-551A MOTION OF DUQUESNE LIGHT COMPANY FOR EXTENSION OF TIME WITHIN WHICH TO PETITICN FOR REVIEW BY THE COMMISSION 9

Duqt Light Company, one of the parties in the

.a above-captioned proceedings, moves the Commission for a 30-day extension of time within which to file a petition with the Commission under Section 2.786 (b) (1) of the Commission's Rules of Practice, 10 C.F.R. 52. 78 6 (b) (1) (1979), and shows in support of its Motion as follows:

1.

The decision of the Appeal Board is very lengthy and particularly difficult to analyze because of the unusual form in which it has been rendered.

The issues raised by the decision require careful consideration because of their impor-tance and several may be appropriate for review by the Commission in view of their novelty and the general novelty of the proceeding itself.

, 2.

The time normally allotted by the commission's Rules of Practice for a party' to consider whether to file a petition for review by the Commission is too short to permit Duquesne Light Company to consider fully the question of petitioning the Commission.

3.

The grant of an extension of time to Duquesne Light Company will not in any way prejudice the rights of other parties to the proceeding since the license conditions contained in the decision of the Appeal Eoard are presently effective and no application for stay of them is pending.

j i

WHEREFORE, Duquesne Light Company respectfully moves the Commission to extend until. October 22, 1979, the time within which it shall have an opportunity to petition the Com-mission to review the decision of the Appeal Board at ALAB-560.

Respectfully submitted, REED SMITH SHAW & McCLAY l
