This is in response to your letter of August 14, 1979 in which you req tested, pursuant to the Freedom of Information Act, documents regarding abnormal settlement at the North Anna and Surry Nuclear Power Stations and information relating to NRC's reasons for not levying a civil penalty against VEPC0 in 1972. This request is being handled as a separate request from your previous F0IA-79-269 request.

The documents listed on Appendices A and B have been identified as subject to your request. The documents listed on Appendix A are available for public inspection and copying at eight cents ($0.08) per page at the NRC Public Document Room,1717 H Street, N.W. , Washington, DC 20555.

The enclosure to document number 2 of Appendix B (duplicated as document 10(d) of Appendix B) is a copy of Investigation Report 50-280/75-1. The names of individuals involved in this Investigation Report have been deleted. They are being withheld front public disclosure pursuant to Exemption 7(D) of the Freed 6m of Information Act (5 U.S.C. 552(b)(7)(D))

and 10 CFR 9.5(a)(7)(iv) of the Commission's regulations, because their disclosure would reveal the identity of confidential sources.

Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Victor Stello, Director, Office of Inspection and Enforcement.

This denial may be appealed to the Commission's Executive Director for Operations within 30 days from the receipt of this letter. As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."

With respect to your request for the April 5,1977 letter from the NRC staff to VEPCO, we have been unable to locate any such document.
