ORDER DIRECTING SUBMISSION OF SCHEDULE FOR PRODUCTION OF SUBPOENAED DOCUMENTS BY SOUTHERN CALIFORRIA EDISON COMPANY (August 15, 1979)

On June 29, 1979, Southern California Edison Company (Edison),

appearing specially, petitioned the Commission pursuant to 10 CFR 52.786 for formal review of the Atomic Safety and Licensing Appeal Board decision in this proceeding.bl The Commission has not granted such discretionary review within the time limit provided therefor, as extended by the Commission, and accordingly the decision cC the

Appeal Board now constitutes the final agency action in this regard (10 CFR $ 2. 786 (b) (4) and (5) ).

In August, 1978, the Licensing Board, at the request of Intervenor State of California Department of Water Resources (DWR),

issued a subpoena duces tecum calling for the production by Edison of.en es'.egories of documents.

By an Order issued January 25, 1979, the Licensing Board denied Edison's motion to quash the subpoena, subject to certain conditions.

Exceptions were filed and briefed by Edison.

The Appeal Board affirmed the Order of the Licensing Board 1/ALAE-550, 9 NRC (June 15, 1979).

. with one modification on June 15, 1979 (ALAB-550).

This decision of the Appeal Board has now become final and enforceable.

Our on-going experience wich discovery involving the voluminous files and documents of the Applicant, Pacific Gas and Electric Company, indicates that it is necessary to establish a feasible and realistic schedule for such document production.

The files of Edison apparently are also somewhat uncentralized and very numerous.

In order to minimize the cost and effort of file examination and document pro-duction, the parties are directed to confer with Edison, a non-party, and exert every effort to eliminate unnecessary document searches.

The parties and Edison are further directed and ordered to submit to the Licensing Board a proposed schedule for the search and production of the documents covered by the subpoena duces tecum, within fifteen (15) days from the date of service of this Order.

It is so ordered.
