ORDER (July 30, 1979)

Miami Valley Power Project, Inc. (MVPP), an intervenor in this proceeding, moved on July 24, 1979 to quash a subpoena issued by us on July 19, 1979 (at the request of the Applicants) for the oral deposition of Mr. Donald Blanch (whom MVPP previously iden-tified as one of.its rebuttal witnesses on Contention 14 and whose affidavit on that subject has been provided to the Board and the parties )~.

In the alternative, MVPP moved for a modification of the time set for the deposition.

In its motion to quash, MVPP represents that " Donald Blanch has recently shown an unwillingness to participate * *

  • as a witness" and that it will not subpoena him to testify on its be-half with respect to Contention 14.

The Applicants have no obj ec-tion to our granting the motion to quash, as long as Mr. Blanch is not offered as a witness.

They make it clear, however, that if Mr. Blanch were to appear as a witness, they would wish first to pursue discovery through depositica or otherwise.

. On the assumption that Mr. Blanch will not appear as a wit-ness on behalf of MVPP, the motion to quash is granted.

If the Board should find that Mr. Blanch's testimony is necessary or desirable in order to achieve a satisfactory record on Contention 14, we will attempt to provide adequate notice to the parties and, if possible, opportunity for discovery.

IT IS SO ORDERED.
