This Intervenor caintains Applicants "First Interog-atories are calculated to interfere with his time available to amend contentions (as pernitted and encouraged by a recent Board Crder and are oc.lv. secondarily involved with information sathering.

Applicant cannot be heard to say in reply that granting Intervenor's notions will delay proceedings. The fault for the slowness of the proceedings to date nust lie in part with Applicant's insisting that only new evidence be accepted for intervention back in 1977 This Intervenor responded to the Board Order following ALA3-535 with contentions that in 7 cases were accepted by Applicant and Board. Thus, this Intervenor had denonstrated skill in detecting issues which should be part of the ACNGS record, and his other contentions should not be lost to public re7:esentation because he is tied up with discovery that can easily be acconolished following the soecial pre-hearing ::nference.

At the heart of any construction license croceeding is the contentions of the parcies. This Interven3r rec.uests he be excused fron answering interagotories he has shown to be unneccesary at this time, in order to contribute nore success' fully to the heart of the natter before us. The notion, then, is to postpone discovery fron Applicant to Intervenor, John 7. Joherty, until after the special pre-heari..c conference.
