Gentlemen:
Enclosed is "NRC Staff Motion for Reconsideration of Licensing Board's Order Granting Consolidated Intervenor's Motion for Consolidation With Coalition for Safe Power".
The Staff's position set forth in this motion is based, in part, on Consolidated Intervenors' failure to provide responsive answers to Staff discovery requests.
On August 3, 1979, after the Staff's motion for reconsideration had been pre-pared in final form, the Staff received " Consolidated Intervenors' Responses to NRC Staff Interrogatories:
Set 2".
These responses, postmarked July 31, 1979, were filed eleven weeks after the Staff filed its interrogatories and more than six weeks after the Licensing Board ordered Consolidated Inter-venors to promptly file responsive answers to those interrogatories. While the responses provide some of the information requested by the Staff and may constitute partial compliance with the Licensing Board's June 15, 1979 Order compelling discovery, the answers, in part, are vague and unresponsive and, in any event, were not filed promptly as the Board directed.
Thus, in the Staff's view, Consolidated Intervenors continue to exhibit recalcitrance in responding to discovery and the Staff's position, as set forth in the enc'.osed motion for reconsideration, is unaffected by the fact that Consolidated Inter-venors filed responses to certain of the Staff's interrogatories on July 31, 1979.
