ORDER SETTLING AND DISCONTINUING PROCEEDING The Staff and Licensee have submitted for approval under 10 CFR 92.203 a joint motion and agreement to terminate this 1/

civil penalty proceeding.-

Among other things, the Licensee makes certain admissions.concerning the Staff's allegations, the Staff agrees that the incident was an isolated act and not a general reflection upon the Licensee's manage-ment or personnel, the parties recognize certain standards that must be met upon entering a reactor cavity, and the Staff approves the Licensee's corrective actions.

Although the Licenree still contends that a civil penalty would be in-appropriate, in consideration of the resolution of the matters as set forth in the agreement, Licensee agrees to pay the civil penalty and withdraws the request for a hearing.

I have reviewed the Staff's Notice of Violation and the Notice of the Proposed Imposition of Civil Penalties, the Licensee's Answer and the other relevant correspondence between 1,/

Although the moving language of the motion refers only to the Staff, it is evident from the rest of the motion that it is a joint filing, and this was confirmed by Staff counsel.

The disposition proposed by the parties is reasonable and is approved.

The proceeding is terminated and discontinued.

The terms of the settlement are embodied in this order.
