" Edison" or " Applicant"), pursuant to 10 CFR 52.711(a',

moves to file instanter its answer to the contentions sub-mitted by the League of Women Voters of Rcckford, Illinois (hereinafter cited as " Petitioners") on Edison's application for an operating license for Byron Station, Units 3 and 2.

ARGUMENT Petitioner filed amended contentions in late July;,1979 and answers from Applicant to those cor '.entions were due August 14, 1979. Because of the gross deficiencies in the form of Petitioner's Amended Contentions, attorneys for Applicant contacted Mrs. Johnson on August 9, 1979 to attempt to arrange a meeting between Petitioners, Applicant and the NRC Staff to revise Petitioner's contentions. thc time, it was agreed in principle to meet, and only the time and place of the meeting were left open. On August 10, 1979, a firm date and location for the meeting were agreed on. However, on August 13, 1979, Mrs. Johnson informed Applicant that the meeting would have to be cancelled because Petitioner's representatives would b'e unabl^ to attend the meeting. This cancellation was on the day before answers were due to Pe~itioner's Contentions.

As a result of Petitioner's last minute cencella-tion of the meeting to revise Petitioner's Contentions, Anplicand was not afforded adequate time to respond in writing to Petitioner's Amended Contentions. Therefore, Applicant requests that the Board authorize Applicant to file instanter its " Answer of Commonwealth Edison Company to the Contentions of the League of Women Voters of Rockford, Illinois "
