Under date of August 6,1979, Mr. John F. Doherty filed a Motion To Postpone Discovery Until After The Next Special Prehearing Conference.
The Applicant's and Staff's responses we : submitted on August 16, 1979.
Mr. Doherty requests that discovery be postponed - i.e. that,until after September 20, 1979, he be excriad from responding to Appi 5 nt's first set of interrogatories and requests for production of documents filed on August 3, 1979.
Presumi':g tint the Board would grant Applicant's Motion of July 30, 1979 which requested that we schedule the special prehearing conference to begin on September 20, 1979, Mr. Doherty asserts that hi.
preparation for the September 20th special prehearing conference would be interferred with should he be required to respond by the due dates to Applicant's discovery.
1104 308 Mr. Doherty's Motion is denied in being predicated on an erroneous presumption.
In our Order of August 6, 1979 (44 Fed. Reg. 47653, August 14, 1979), the Board scheduled the special prehearing conference to begin on October 15, 1979.
Further, in an order being issued this day, Mr. Doherty, among certair other named individuals and organizations, is allowed until 7910050[O
f 4 September 14, 1979 to amend his contentions.
Although the instant motion is denied, Mr. Doherty shall have until September 21, 1979 to respond to Applicant's First Set Of Interrogatories And Requests For Documents.
