'Public Notice No. 79TN0015 September 20, 1979 NOTICE OF PROPOSED MODIFICATION OF NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT AND NOTICE OF CONSIDERATION FOR STATE CERTIFICATION Ihe U. S. Environmental Protection Agency (EPA) proposes to modify National Pollutant Discharsri Elimination System (NPDES) permit issued to the Tennessee Valley Authority, 268 401 Building, Chattanooga, Tennessee 37401, for its Hartsville Nuclear Constr'..ction Project, Smith and Trousdale Counties, Tennessee, application nuraer and NPDES number TN0027740. Three ps. int source discharges enter the Cumber?.and River in the vicinity of River mile 285. The proposed modificatien vill in- -

corporate a fourth-point source discharge of runoff from a borrow area holding pond, into the existing permit which includes plant construction and domestic wastes. This reach has been classified by the State of Tennessee for all uses.

The proposed NPDES permit contains limitations on the amounts of pollutants allowed to be discharged and was draf ted in accordance with the provisions of the Clean Water Act (33 U.S.C. Section 1251, et. s e.q . ) ,

and other lawful standards and regulations.

The proposed modifications are tentative and open to comment from the public. Persons wishing to comment upon or object to the proposed modifications are invited to submit same in writing within 30 days from the date of this notice to the Enforcement 345 Courtland Division, U. S. Environmental Protection Agency, Street, N. E., Atlanta, Georgia,'30308, ATTN: Mona Ellison.

The NPDES number should he included in the first page of comments.

All comments received within the 30-day period will be considered in the formulation of final determinations regarding the modifications. Where there is a significant degree of public interest in the proposed permit modifications, the EPA Regional Administrator will hold a public hearing.

at; Af ter consideration of all written comments and of the requirements and policies in the Act and appropriate regulations, the EPA Regional Administrator will make determinations regarding permit modification. If the determinations are substantially unchanged from those announced in this notice, the EPA Regional Administrator will so notify all persons submitting written comments.

If the determinations are substantially changed, the EPA Regional Administrator will issue a public notice indicating the revised determinations. Requests for adjudicatory hearings may be filed af ter the Regional Administrator makes the above-described determinations. Additional information regarding adjudicatory hearing is available in 40 CFR 125.36, or contacting the Legal Support Branch at the address above or at 404/881-3506.

Additional information on EPA's proposed determinations is available by writing the EPA address above. A copy of the modified draft permit is also available from EPA. The application, comments received, and other information are available for review and copying at 345 Courtland Street, N. E. , 3rd floor, Atlanta, Georgia, between the hours of 8:15 a.m. and 4:30 p.m. , Monday through Friday. A copying machine is available for public use at a charge of 20c per page.

The Tennessee Department of Public Health has been requested to certify discharme in accordance with the provisions of Section 401 of the Clean k'ater Act (33 U.S.C. Section 1251 et. seq.). Persons wishing to comment on the state certification of this discharge are invited to submit same in writing to the state agency address above within 30 days of the date of this notice.

If a public hearing is held, as described above, the state agency will co-chair the hearing in order to receive comments relative to state certification.
