Dear Ms. Deluljak:
An Atomic Safety and Licensing Board has been designated to conduct any hearing which may be required with respect to the request for a heart.g by Ohio State Sent tor Tim McCormack.
I will serve as cht;:.rman of the Board.
A copy of your letter dated June 18, 1973 to Commission Chairman Hendrie and a copy of the letter datect July 6, 1979 from Mr. Denwood F. Ross, Jr.
to you, have been made available to the Board.
Enclosed is a copy of the Commission's Order dated July 5, 1979 which authorizes the Davis-Besse proceeding.
Also en-
-closed is a copy of the Commission's rules concerning inter-vention in NRC proceedings.
It is not clear whether this Board has jurisdiction to consider your request, but we want you to have an opportunity to submit further information so that appropriate consideration may be given.
Accordingly, I would appreciate your answers to the following questions :
1.
In light of the information in Mr. Ross' letter to you, and the Commission's Order of July 5, are you still interested in the matter?
2.
If so, would you want to participate in any hearing on the matter?
3.
If you wish to par91pate in a hearing held pursuant to the Commissior +
rde r, please state how your interests may be affected by the results of the proc eeding.

The Commission's earlier Order, dated May 16, 1979 (enclosed in Mr. Ross ' letter to you) and published in the Federal Register on May 22, at 44 Federal Register, 29768, provided that any person whose interest may be affected by the Order may request a hearing within twenty days of the date of the Order.
Was your request made pursuant to the Commissior s Order of May 16, 1979?
If so, please explain why it was not nade within 20 days of May 16, 1979.
The enclosed intervention rule exp.lains the con-siderations to be given to late-filed requests for hearings.
Please answer this letter on or before July 31, 1979.
