During the past several months Messrs. G. Bellisario and D. Sherwood of your staff and Mr. Thurman of my staff have discussed several topics which affect your material control program.

As a result of those discussions, we have determined that changes in your Fundamental Nuclear Material Control (FNMC) Plan are necessary. We are requesting that you make the FNMC Plan changes and, where required, to modify your material control program as soon as practicable.

The first topic of concern is the creation of two FNMC Plans - one for the low enriched uranium (LEU) operation and the other for the plutonium (Pu) operation.

The separate Plans were discussed during the February 1979 visit of Mr. Thurman, and both staffs agreed that separate documents were needed and would facilitate administrative controls. The following guidance was provided concerning the new FNMC Plans. Since the high enriched uranium (HEU) operation has been terminated and the shutdown / cleanout operations are covered by separate plans, all references to the HEU operations should be dropped from the two FNMC Plans. The FNMC Plans should be restructured to accommodate the measurement control program which was incorporated as part of the current FNMC Plan.

Finally, the format of the two FNMC Plans may deviate from the standard format in Regulatory Guide 5.45, as long as all subjects are properly covera.

The second topic is the use of factors in the LEU operation.

Even though your staff explained the procedures for determining and applying factors, this inforration needs to be included in the measurement section of your FNMC Plan. The information should include a description of your factor verification program; describe when and where the factors are to be used; describe the type and typical quantity of material normally based on factors; and describe when and how factors are updated. The impact that the factors could have in terms of potential bias to the ID and contribution to the LEID must also be described, but it may be supplied in the appendix.

The rudimentary requirements for sampling and measurements must be described for each factor as they apply to each material type.

The final topic concerns your December 13, 1978 submittal for material control areas.

The review of the submittal has been completed and specific comments are provided in the enclosure.

These comments augment the discussions between your staff and Mr. Thurman at Apollo in February 1979.

Please contact Mr. Thurman if you have any questions concerning this request.

Also, provide a schedule for submitting the two FNMC Plans including the revisions for the LEU activities.

It has been determined that the attachments to your December 13, 1978 letter and the enclosure to this letter contain information of the type specified in 10 CFR 2.790(d). Accordingly, pursuant to Section 2.790(d)(1),

such information is deemed to be commercial or financial information within the meaning of 10 CFR 9.5(a)(.4) and shall be subject to disclosure only in accordance with the provisions of 10 CFR 9.12.
