Dear Mr. Knotts:
At the present time, it is not our intention to call Mr. W.H.
Holcomb,- Jr., Mr. Carl Morgan, and Mr. Carl Messec as witnesses in this proceeding.
Counsel for the NRC and the DOJ have indicated that they also have no present intention to call these individuals as witnesses.
In the event Tex-La or other parties to this pro-ceeding decide at a later time that it will be necessary to call one or more of these individuals as witnesses in this cause, counsel for TUGCO and Houston Lighting & Power ("HL&P") will be so advised and provided with an opportunity for oral deposition (s) should such a deposition (s) be requested.
Based on the foregoing and our recent informal discussions re-garding the scheduling of depositions previously noticed by TUGCO and HL&P in this proceed.ing, it is our understanding that the depo-sitions of Mr. W.H.
Ho'. comb, Jr., Mr. Carl Morgan, and Mr. Carl Messec, scheduled for August 7, 14, and 17 respectively, are hereby cancelled.
With respect to the subpoenas to the Keepers of the Records for Houston County Electric Cooperative, Inc., Jasper-Newton Elec-tric Cooperative, Inc., and Rusk County Electric Cooperative, Inc.,
