APPLIChT'SRESPONSETOPETITION FOR LEAVE TO INTERVENE FILED BY ELINORE P. CUMINGS Applicant files this response to the petition for leave to intervene in this proceeding filed by Elinore P.

Cumings, apparently a resident of Rosenberg, Texas.

Although the petition touches vaguely upon many subjects (e.g. , the efforts of petitioner's family to cut energy consumption; the " moral issue" posed by radioactive wastes; concerns regarding "the integrity of the builders" and the fact that " Anytime the profit motive enters in there is a risk of corners being cut") none begin to satisfy the requirement of 10 CFR 2.714(a)(2) that the petition set forth "the specific aspect or aspects of the subject matter of the proceeding as to which petitioner wishes to intervene."

The petition also plainly fails to satisfy the requirement of the Board's Notice of Supplementary Intervention Procedures that a petitioner:

"shall set forth that he failed to file a petition

. . . pursuant to the Board's notices of May 31 and September 11, 1978, because of restrictions on permissible contentions contained in those notices."

Petitioner simply states that she did not attempt to intervene previously "because I did not know about the proposed facility nor about the earlier hearing." It is clear from petitioner's own statement that she could not have been dissuaded from intervening by the prior restrictions on admissible contentions in the eariler notices if, as she states, she was unaware of the prior proceedings. The petition thus does not qualify under the requirements of the supplementary Notice; further, it fails as a nontimely filing since it was submitted without reference to the factors enumerated in 10 CFR 2.714(a)(i)-(iv).

Accordingly, the petition should be denied.
