Dear Mr. Cochran:

This is in further response to your letter dated July 6,1979, in which you requested, pursuant to the Freedom of Information Act, all documents generated or utilized by the Task Force on Safeguards Policy and any subsequent information developed by the NRC pertaining to recommenda,tions of the Task Force.

The documents listed in Appendix A are being placed in the NRC Public Document Room (PDR),1717 H Street, N.W., Washington, DC.

The enclosures to documents 1 and 3 of Appendix B are drafts (February 27, 1979 and March 12,1979) of the Report by the Task Force on NRC Safeguards Policy. The documents reflect the Task Force's advice, conclusion, deliberations, opinions and recommendations and are being withheld from public disclosure pursuant to Exemption (5) of the Freedom of Information Act (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations. The non-exempt cover memos of these documents are being placed in the PDR.

Portions of document 2 of Appendix B are excerpts from the February 8, 1979 draft Report by the Task Force on NRC Safeguards Policy. That draft report reflected the Task Force's advice, conclusion, deliberations, opinions and recommendations and was withheld from public disclosure in nty letter to you dated August 30, 1979.

For the same reasons, these excerpts are being withheld from public disclosure p(b)(5)) and 10 CFR ursuant to Exemption (5) of the Freedom of Information Act (5 U.S.C. 557.

9.5(a)(5) of the Commission's regulations.

The non-exempt portions of this memorandum are being placed in the PDR.

Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. The persons responsible for these denials are the undersigned and Mr. William J. Dircks, Director, Office of Nuclear Material Safety and Safeguards.

These denials may be appealed to the Commission's Executive Director for Operations within 30 days from the receipt of this letter.

As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations; U.S. Nuclear Regulatory Commission, Washington, DC 20555 and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."
