ORDER (July 24,1979)
On July 23, 1979, the NRC Staff filed a Motion to bbdify Return Date of Subpoena of Carl Stover. Therein, the Staff requested modification of the return date for both the subpoena issued to Mr. Carl Stover and the subpoena issued to the keeper of the records of C. H. Guernsey, Inc. The taking of the deposition and the production of documents were scheduled for July 24, 1979.
Because of the shortness of time, a conference call was placed in the afternoon of July 23rd.
Participants were David Toll, Esq., representing HISP; Joseph Knotts, Esq., representing TU; Roy Lessy, Esq., representirg the Staff; Judith Harris, Esq., representing the Department of Justice; and Robert O'Neil, Esq., representing Mr. Carl Stover.
This Order confirms that, after hearing the argurents by counsel for the parties in this case, the Acting Chairman denied the Staff's instant Motion to Modify. Good cause has not been sham by the Staff.
