Dear Ms. Weiss:
This is in further response to your letter dated May 4,1979, in which you raquested, pursuant to the Freedom of Information Act, documents and other records produced by the Inspection and Enforcement staff or its agents.
The document listed in Appendix A to this letter is being placed in the NRC Public Document Room, 1717 H Street, N.W., Washington, DC.
Portions of document 1 of Appendix B are being withheld from public disclosure pursuant to Exem Act (5 U.S.C. 552(b)(7)(C))ption (7)(C) of the Freedom of Information and 10 CFR 9.5(a)(7)(iii) of the Commission's regulations, because disclosure of the information would constitute an unwarranted invasion of personal privacy.
Portions of document 2 of Appendix B have been deleted in order to protect the personal privacy of the individuals involved.
The deleted information consists of home telephone numbers or home addresses, which represent approximately 95% of the deletions; the names of private citizens (where other personal information is involved); the names of individuals who may have been exposed to radiation; and the names and other personal information concerning reactor operators where that information is directly associated with their operator examinaton test Because disclosure of the information would constitute a clearly scores.

The non-exempt portions of Appendix B documents have been placed in the PDR.
Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The person responsible for the denial of portions of document 1 of Appendix B are the undersigned and Mr. David G. Flanders, Chief, Freedom of Information-Privacy Acts Branch, Federal Bureau of Investigation. The person responsible for the denial of portions of document 2 of Appendix B is the undersigned.
The persons responsible for the denial of portions of document 3 of Appendix B are the undersigned and Mr. Victor Stello, Director, Office of Inspection and Enforcement.
These denials may be appealed to the Commission's Executive Director for Operations within 30 days from the receipt of this letter.
As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555 and should clearly state on the envelope and i'n the letter that it is an " Appeal from an Initial F0IA Decision."

Dear Mr. Felton:
J On behalf of the Union of Concerned Scientists, I submit this Freedom of Information Act request for further documents related to the recent accident at Three Mile Island Unit #2.
In a letter of April 6, 1979, I requested communications and log books related to the accident.
This request relates specifically to documents and other records produced by the Inspection and Enforcement staff or its agents.

Please provide copies of the following:
1.
All docur.ents or other records prepared by the I&E staff concerning the accident at TMI #2, in-cluding interviews with operators and other personnel and the actions that have been o'

-l respect to that reactor.
2.
All documents or other records prepared by the I&E staff that concern other nuclear reactors con-structed by Babcock and Wilcox and that are related to or reflect the occurrence of the accident at TMI

I request that the NRC waive any fees for the production of these documents as provided by 5 USC S552 (a) (4) (A).
I request further that you assure that the records provided to us are complete as of the date of your response so that we will be fully up to date on developments concerning TMI #2 and the other B&W reactors.
I understand from conversations with Mr. Grimsley and others that your staff is hard pressed to respond to the large numbers.of FOIA requests that the NRC is now receiving concerning Three Mile'

I suggest a procedure that should simplify their k
effort and help you avoid extra paperwork involved in re-sponding to new individual requests or to supplementary requests.
If the Commission will commit itself to place all documents related to Three Mile Island and to other B&W reactors on the public record within one week of the date on which they are received or prepared, I am sure that UCS and other interested groups would feel less need to i
file formal FOIA requests, and particularly, they would i
feel less need to file supplementary requests to assure that they have all documents that have come to light since the Commission's response to their earlier requests.
O'f course, if the Commission were to determine that some documents should not be released, it would have to give pub-lic notice of that decision so that UCS and others could 4
consider whether they should formally request those docu-monts.
I hope that this procedure meets with your approval.
I believe that it is the interest of all involved.
