(Allens Creek Nuclear 5 Generating Station, Unit 1) 5 APPLICANT'S RESPONSE TO PETITION TO INTERVENE FILED BY STEPHEN A. DOGGETT Applicant files this response to the petition for leave to intervene filed in this proceeding by ' _ephen A.

Doggett. The petitioner recites that he lives, works, and owns property a certain distance from the proposed plant and then enumerates four general concerns about nuclear power:

(1) transportation of nuclear materials and waste, (2) dis-posal of waste materials, (3) " effects" on his property values, and (4) effects on his electricity rates.

None of the concerns expressed by petitioner are stated with the degree of particularity sufficient to meet the requirements of 10 CFR 5 2.714(a). Petitioner's general-ized statement of concerns fails to qualify as a statement of "the specific aspect or aspects of the subject matter of the proceeding as to which petitioner wishes to intervene."

4 property values and rates) are solely concerned with economic injury which is insufficient to confer standing to intervene -

(hereinafter " Order").

Additionally, under NRC precedent, at least one contention must be stated with reasonable specificity and with supporting bases in order to support a grant of interven-tion. 10 CFR 6 2.714(b); Northern State Power Co. (Prairie Island Nuclear Generating Plant, Units 1 and 2) (ALAB-107, 6 AEC 188, 194 (1973). Petitioner has failed to comply.

Petitioner's concerns with respect to health and safety refer to matters which are outside the scope of this proceeding.

The environmental effects of transportation of nuclear materials to the site and radioactive waste from the site are specified in Section 51.20(g)(1) and Table S.4 of the Commission's Regulations. Petitioner's allegation is thus nothing more than an impermissible challenge to the regulations.

To the extent petitioner alleges that a transporta-tion accident could affect his interest, the assertion is a

'a f b, <! L based on nothing more than pure speculation and as such, is not a proper basis to support standing. Exxon Nuclear -

Petitioner's concern about radioactive waste dis-posal, even if stated with greater specificity and supporting bases, is also a subject which is not proper for litigation in this licensing proceeding. The environmental effects of the disposal of radioactive wastes are set forth in the Com-mission's regulations. 10 CFR S 51.20(e) and Table S-3.

Absent a showing of special circumstances, they cannot be challenged here. 10 CFR S 2.758. Order, p. 30.

Finally, there is some confusion whether Petitioner qualifies for the waiver of the nonetimely. filing criteria e

under the Supplementary Notice (44 Fed. Reg. 35062, June 18, 1979) for those "who did not file a petition pursuant to the notices of May 31 and September 11, 1978, because of the restrictions on permissible contentions contained therein."

Petitioner states that he did not intervene under the original notices "because prior intervention notices stated that petitions should be limited to addressing changes made in the plans for the proposed facility or information not previously available." However, in the very same sentence o c4 233

Mr. Doggett states that he was not even aware of the interven-tion procedures set out in the prior notices. Obviously, -

one of his statements must be incorrect. Neither Applicant, the Staff nor the Licensing Board is in a position to letermine which of these mutually exclusive reasons for late filing is accurate. For the reasons stated in a prior response, Applicant believes that if the Board should find that this petition is sufficient in other respects, it is important to determine which of the contri.lictory statements is genuine, by evidentiary hearing if nrad be.

For the foregoing reasons, Applicant believes that this petition should be denied and that, in any event, it cannot be granted without further proceedings relating to the accuracy of petitioner's statements concerning his prior failure to intervene.
