JOINT MOTION BY THE DEPARTMENT OF JUSTICE AND THE NUCLEAR REGULATORY COMMISSION STAFF FOR PARTIAL RECONSIDERATION OF THE BOARD'S ORDER OF JUNE 25, 1979 AND APPLICATION FOR ISSUANCE OF SUBPOENAS By order dated June 25, 1979, the Board amended the schedule for these proceedings set forth in the Prehearing Conference Order of April 4,1979.

In so doing, the Board basically followed the recommendations of the Nuclear Regulatory Commission S taf f ("S taf f") and the Department of Justice

(" Department"). 1/

However, since the time that recommendation was made, several events have occurred which make it necessary for the Department and Staff respectfully 1,/ The Staff suggested a minimum of 60-90 days as an extension of the discovery period.

In its June 25, 1979 Order, the Board extended discovery by 60 days.

and postpone the October 30, 1979 cutoff for discovery to j

t December 31, 1979.

The most important of those events was the noticing of f

\\

depositions by Houston Lighting & Power Company ("HL&P") and

{

l Texas Utilities Generating Company ("TUGCO").

By joint application served by mail on June 18, 1979, BL&P and TUGCO requested the issuance of 57 subpoenas for depositions and 19 subpoenas for the production of documents.

Those subpoenas have been issued by the Board.

l The 57 depositions noticed by HL&P and TUGCO span the period July 5 through November 8, 1979, which is, in itself, beyond the discovery cutoff date of October 30, 1979 set by

the Board.

The deposition schedule of HL&P and TUGCO

I consumes 64 working days and leaves all other parties with

only 25 working days during that time period to notice and i

complete their depositions. 2/

The Department, jointly with the S taf f, is filing i

herewith applications to notice approximately 20 subpoenas for testimony and 12 subpoenas for the production of documents after October 30, 1979. 3/ In addition, the Staff 2/It is recognized that under Rule 26(d) of the Federal Rules of Civil Procedure discovery should proceed concurrently.

Thus, a party may not preclude the discovery of another party by use of its deposition schedule.

The Department concurrently is applying for the issu-ance of 20 subpoenas for testimony and 12 subpoenas for the production of documents to be taken prior to October 30, 1979. o i m &x u n. e u

approximately 24 subpoenas for testimony and production of I

documents.

In scheduling these depositions the Department j

ti and the Staff have attempted to fill in the interstices I

left in the discovery period by BL&P and TUGCO, while still leaving some leeway for inevitable rescheduling, travel connections and the like.

It shoulf also be pointed out that the Department and the Staff have planned multiple depositions (often in different parts of the country) on many days during this time period.

Nonetheless, the

best schedule that the Department and the Staff can arrange t

involves nocicing depositions through the month of December, 4

1979.

As the calendar attached to this motion (as Appen-dix A) makes clear, this is a highly ambitious plan. 4/

All parties have been planning their discovery schedules j

for a period of "90 p.us" days from the previously scheduled t

discovery cutoff date of July 30, 1979.

The Board should take note that the proffered calendar does not even take into account depositions likely to be noticed by other parties, such as Central and Southwest Corporation and the Public Utilities Board of the City of Brownsville, which to date have played a very active role in these proceedings.

Moreover, the calendar leaves very little room for rescheduling due to unanticipated events, prior commitments of counsel or deponents, and for the noticing of additional deponents whose names come to light during the continuing discovery process.

In addition, since most of these depositions will take place in Texas, additional discovery and necessary trial preparation will be difficult to complete since the Department and Staff attor-neys will not even be in their offices in Wasnington during mucn of the discovery period. bbN

It now appears that at least that much time will be necessary to complete depositions. The interests of I,

justice are not served by not giving the parties sufficient j

time during discovery to depose those persons in possession i

of relevant information.

likely result in the refining of issues and a shortening of I

the time needed to conduct an evidentiary hearing.

I For all these reasons, the Department and Staff now ask that the Order issued by the Board on June 25, 1979, permitting discovery until October 30, 1979, be amended to reflect current realities and that the schedule of these proceedings be as follows:

December 31, 1979 --- completion of all discovery.

In addition to, and in conjunction with, this requested schedule change, the Department and the Staff respectfully request, pursuant to 10 C.F.R. 5 2.720, that the Board issue the subpoenas, identified in Appendix B hereto, that are being filed with this motion.

The subpoenas listed in Appendix B are for depositions and document productions that the Staff and the Department propose to take after October 30, 1979, but before the end of December. 6/ These subpoenas call for the giving of testimony and the production of documents which are relevant to the issue of competition in the electric utility industry in the State of Texas and surrounding states, the structure of the electric utility industry in and reasonably adjacent to the State of Texas, 6/ Those depositions (and documentary productions) which the Department and Staff propose to take in advance of the present October 30, 1979 cutoff for discovery are being filed concurrently with this motion, but along with a separate application for issuance of subpoenas.
