RFP-67-153827 ANEFCO CODE 15154 Shielded Shipping Cask for Radioactive Material

Dear Mr. Snell:

ANEFCO Inc. hereby wishes to go on record in protest of the non-award of the above RFP.

This solicitation had a due date of June 4, 1979.

We were asked to supply a cask by September 1, 1979 which was acknowledged by TVA as impossible but were asked to indicate the earliest possible delivery date in the proposal.

This we complied with, and according to the public opening figures for the total price, AMEFCO proposed the lowest bid and complied with all the necessary specifications.

We were asked to extend the validation of our bid to August 3, 1979.

This was requested because TVA stated that the cask was no longer licensed to be used as requested.

In checking with the NRC however, we discovered that the cask was indeed still licenseable and that the TVA petition for changing the closure had been withdrawn in December of 1973.

ANEFCO indicated by our letter of June 25, 1979, that our personnel have the expertise to redesign the closure or to design any cask for TVA and so forwarded documentation for sane.

In telephone conver.sation today, we vere inforced that this bid will not be awarded since a special arrangement called a personal service contract with a Washington, D.C.

corporation has been arranged to design a new cask or closure.

If TVA issues a solicitation for services or products it should be with the intention of awarding a contract.

Again on July 23, we were requested to forward a copy of our Quality Assurance Manual for Shipping Packages for Radioactive Material.

Our questions remain; why did you request the QA Manual on July 23, and not sooner; and thereby indicate this RFP was still valid and why now did we have to call you to find out you have decided not to award this contract?

We want to know why a company can be given a contract to design or redesign an item without a formal bid especially when the existing cask for which the original RFP issued, is still a licensed and useable cask.

There are many companies which have the expertise to design casks.

Why can you allow this to be done sole source?

It is time to assess these practices.

We expect an answer in writing.
