Dear Mr. O' Leary:

Your July 19, 1979 letter to Chairman Joseph M. Hendrie regarding allegations of anticompetitive activities in Louisiana has been referred to me.

The Antitrust and Indemnity Group (AIG) of my staff in conjunction with the Antitrust Division of the Office of the Executive Legal Director (ELD) is currently reviewing the Operating License applications of Louisiana Power and Light Comoany with respect to its Waterford Nuclear Power Plant and of Mississippi Power and Light Company with respect to its Grand Gulf Nuclear Plant to see if any significant changes have occurred in the licensees' activities in the context of Sec.105c(2) of the Atomic Energy Act of 1954, as amended.

Since the Waterford and Grand Culf Construction. Permits each have antitrust license conditions attached to them, the "significant change" review also involves the consideration of whether the Companies are complying with their license conditions.

My staff advises me that they are aware of the allegations and other matters listed in your July 19 letter and are considering them in the antitrust reviews. Members of the AIG staff have in the past discussed some of these matters with Mr. T. Crawford Honeycutt, Chief Economist in your Office of Competition, when he was previously employed with the NRC. We will be pleased to continue to keep him advised of the status of cur antitrust review activities with respect to Louisiana Power and Light Company and Mississippi Power and Light Company.
