Dear Mr. Dattilo:
On June 12, 1979, you sent me a copy of an affidavit which you requested be considered as part of your earlier requests to reopen the safety hearings or order suspension of the construction permits for the Marble Hill facility.
The affidavit contained allegations by a former construction worker at Marble Hill concerning deficiencies in concrete repair at the site. In my letter of July 6,1979, I informed you that the allegations raised in ycur letter are uncer investigation by the Of fice of Inspection and Enforcement (IE).
On the basis of information that you provided and.cther information reported by the licensee and developed in IE's investigation, the Director of Inspection and Enforcement has issued the attached Order which suspends certain construction activities at Marble Hill. Accordingly, your June 12th petition is aranted insofar as it requested an order suspending the construction pemits. The granting of ycur request does not, however, automatically entitle you to a hearing with respect to the Order. You must establish any right to request a hearing under the Order itself.
