Dear.4r. Heyars:

Following receipt of dnder Secratary.iyers' August 4,1373 letter, members of my stc.ff have met several times with Or. Certal and nis staff. These meetings have also involved direct participation of otner Jepartment of Energy (30E) and 00E contractor staff. During our meetings, we discussed tne present status of the ccamercial burial grounds, tiie need for contir.gency planaing, and early resolution of issues regarding the need and as urance of back-up capacity for cccmercial lou-level waste (LLi!).

I would like to reemphasize our concern that the Federal governr.ent ce prepared for a contingency regarding adequate capacity for manage-r.mn t of cc=ercial LLU.

It appears that 30E is the logical Federal agency to carry cut suca planniag and to provide back-up capacity saculd the need arise.

le are pleased with the degree and promptness of v0E's response to the contingency planaing need. As required, we will coatinue to provide ycu guijance and assistance in developing a contingency plan.
