June 8,1979 Note to File TMI-2 On or about May 7,1979, I received a phone call from Mr. Alan Rosenthal, Chairman of the Atomic Safety and Licensing Appeal Board designated in the Three Mile Island, Unit 2 proceeding. Mr. Rosenthal indicated that he was seeking information on the subject of emergency planning and stressed that, in view of the Appeal Board's final disposition of this issue in the TMI-2 proceeding last July (ALAB-486), he was seeking it for per-onal information and not in tne context of the proceeding. Mr. Rosenthal inquired whether the absence of NRC's concurrence in the Commonwealth of Pennsylvania's emergency plan, discussed in an issue of Nucleanics Week, may have any bearing on the Staff's position on the record in the proceeding before the Licensing Board, that the Licencee's emergency plan ccmplied wi:n 10 CFR Part 50, Acpendi:. E, and whether in light of the lack of concurrence, the plan was nonetheless accentable.
The toregoing was discussed with Wayne Houston, NRR, and Harold Collins, OSP. I was informed by them that present practice is tor the NRR stait to seek the views of OSP on the adequacy of an applicant's :mergency nlaas Irem the standpoint of :ny impacts attributable to the cognizant state's clan. The review of the T:JI-2 emergency plan predates institution of this procedure but 1ir. Housten was of the belief that the lack of NRC concurrence in the Commonwealth's plan was due to the Commenwealth's inability to resolve internal problems regarding its organizational structure and jurisdiction and its disinclination to become involved in the NRC's program, ind, that neither aspect would affect the staff's conclusion that the licensee's clan was acceptable, adequate and complied with Acpendi.< E.

.dr. Collins also noteu that the Commonwealth's plan, a draft of wnich was submitted for comment in 1975, has not been resubmitted for NRC concurrence. The foregoing information was pro-vided to Mr. Rosenthal on May 30 and June 1,1979.
