-SECY-18-0042-DRAFT FINAL NUREG/BR-0058, REVISION 5, " REGULATORY ANALYSIS GUIDELINES OF THE U.S. NUCLEAR REGULATORY COMMISSION" In light of the Commission's recently concluded action on SECY-18-0049 , " Management Directive and Handbook 8.4 , 'Management of Backfitting , Issue Finality, and Information Collection
,"' and the resultant revisions to Management Directive (MD) 8.4, the Commission is returning SECY-18-0042 to the staff without prejudice.
The staff should conform NUREG/BR-0058 to MD 8.4 as approved in SRM-SECY-18-0049 and return it, as further revised, to the Commission for its review and approval no later than six months from the date of this staff requirements memorandum.
Additionally , the staff should resume its work on revisions to agency internal procedures and guidance governing backfit provisions, including the planned revisions to NUREG-1409 , "Backfitting Guidelines
." The staff should conform NUREG-1409 to MD 8.4 as approved in SRM-SECY-18-0049 and, due to the significant overlap in subject matter between MD 8.4 and NUREG-1409, provide NUREG-1409 to the Commission for information ten days prior to issuing a draft version for comment and again ten days prior to issuing a final version. The staff's estimate for the time necessary to finalize NUREG-1409 includes two 3-month periods for internal NRC concurrence.
The Commission notes that this document update may present an opportunity to pilot new concurrence processes currently under development.
