HARO TESTIMONY Undoubtedly the question of whether there was a license violation in connection with the closed outlet valves on the auxiliary feedwater pumps will be brought up at the hearing tomorrow.

It is important that your response avoid the two pitfalls of either appearin. evasive about the issue or having prejudged a matter of law or fact that you will be called upon formally to review in the future.

I suggest that the Chairman either address it directly in his testi-mony or be prepared to respond to Subccmmittee questions.

I believe an appropriate response would be:

Under licensee requirenents in force at Three Mile Island at the time of the incident, operation of the facility with these valves closed would not have been allowed.

We have not completed our investigation of this extremely serious aspect of the TMI situation.

Therefore, I should enphasize that final conclusions about the problem relating to closure of the auxiliary feedwater valves -- from both an operational and enforcement standpoint -- can only be reached when all the evidence is in.

However, at this stage the Commission believes this matter to be of extreme seriousness, warranting the closest attention from a generic safety standpoint.
