ORDER TO ASS ME AfiD C0fiFIRM DIRECT NRC REGULATORY AUTHORITY OVER EMERGEtiCY SITUATICN Beginning March 25, 1979, a series of events at Unit No. 2 of the Three Mile Island Nuclear Power Station resulted in an emergency situation which continues to exist.
The Atomic Energy Act of 1954 confers broad regulatory power on the Nuclear Regulatory Commission to protect publiu health and safety, including plenary authority to control actions to be taken by a licensee in an emergency situation.
Representatives of the licensee have agreed that the Commission does have the authority, in the event of any disagreement, to determine which steps shall be taken. Nevertheless, since important safety decisions remain to be made, the Commission believes it necessary to confim its previous understandings with the licensee and to dispel any possible doubt about where tric authority to decide those questions resides.

Representatives of the licensee shall take no action [(broad option) of safety significance relating to the present emergency] [(narrow option) which may change either the rate of release of radioactive gases or the way of cooling the reactor vessel] until after they have consulted with and obtained the coccurrence of the Director of Nuclear Reactor Regulation or his designated representative.
This Order is issued pursuant to Section 186 of the Atcmic Energy Act,10 CFR 2.202, and the Cor: mission's inheren t supervisory authority over all matters within its jurisdiction. Counsel for Metropolitan Edison Company has consented to entry of this Order.
