_o DOC"2T :!O. 50-320 Sy letter dated May 1,1969, the Metrepelitan Edison Cc pars and Jersey Central Power & Light Cc pany, co-cwners, requested an exemption frc provisions of Section 50.10(b), pursuant Oc Section 50.12 cf the Cecnission's rules to permit construction of the ten-den access gallery for the Three Mile Island Nuclear Station Unit 2 prior to issuance of a construction permit.

The applicants' basis for performing the requested ccnstruction is that the tenden access gallery does net function as a saf ety f eature of the containment building, and delaying the placing of the tendon access gallery would delay the overall construction of the facility.

The overall construction schedule has been establisned to provide suf ficient power generation capacity to reet General Public Utilities System's May 1973 pcwer require =ent.

Installation of the tenden access galler/ would percit the applicants to proceed with other pre-constructicn permit verk invciving the pouring of the concrete seal cat and placing of reinforcing steel for the base slab.

Tae gallery is a reinforced concrete passage located belcw the cen-tainment building base slab but does not function as support for the building. The tendon access gallery is provided to permit installation of the containment building vertical prestressing tendens.

Our review of the exe=ption request indicates the tenden access gal-lety is for the installation of the prestressing tendons and does not serie as a structural foundation. Tne geological considerations f or the Three Mile Island site have been reviewed and it has been determined that there are no unusual foundation problems.

'.ie have reviewed the adequacy of the quality assurance prog = for cons t:ac-tien of the tenden access gallery regardinz design, applicable ccdes, concrete specifications and ccnstruction.

.ie have also considered the applicants ' quality assurance organicatien and we cenclude it is adequate to assure that the abeve quality assurance features are carried cut throughout construction of the tenden access galler/.

Our revie'.4 of the exemption request was based on the applicants' supporting infor atien meeting the five criteria stcted in Section 50.12 (b ), Specific exe:pt!.cns, dated February 19, 1969, c f 10 CF2 Part 50, Licensinc of Procuction and Utili::ation Facilities.

We have also considered the applicants' quality assurance organir.ation and we conclude it is adequate to assure that the above quality assurance features are carried out throughout construction of the tendon access gallery.

Based on our review of this infornation, we have concluded that there is a need for the energy to be produced by the proposed power reactor on the schedula projected by the applicants.
