ORDER RESCINDING SUSPENSION OF CERTAIN CONSTRUCTION ACTIVITIES AT THE THREE MILE ISLAND NUCLEAR GENERATING STATION, UNIT 2, PENDING COMPLETION OF NEPA ENVIRONMENTAL REVIEW On February 7, 1972, the Director of Regulation of the Atomic Energy Commission issued an order suspending activities for the Three Mile Island Nuc' lear Generating Station, Unit 2, involving off-site right-of-way clearing and construction of the Juniata transmission line pending completion of a review of the e n vi ronmen ta l impact of such activities under the Commission's regulations implementing the National Envi ronmen tal Policy Act of 1969 (NEPA), 10 CFR Part 50, Appendix D.
The Director of Regulation has reconsidered that order of Feoruary 7, 1972, and has determined to rescind that suspension as set forth in a document entitled " Determination to Rescind Suspension of Certain Construction Activities at the Three Mile Island Nuclear Generating Station Authorized Pursuant to CPPR-40 and CPPR-66 Pending Completion o F NEPA Environmental R e v i~e w "
dated April 2, 1973

S. Atomic Energy Commission Relating to Consideration of Suspension Pending NEPA Environ-mental Review of the Provisional Construction Permits for the Three Mile Island Nuclear Generating Station, Units 1 and 2" dated December 9, 1972, appended hereto and made a part he reo f, and in the document entitled " Final Environmental Statement Related to the Operation of Three Mile Island Nuclear Station, Units 1 and 2" dated December, 1972.
In view of the foregoing, IT IS ORDERED THAT, effective 30 days following publication of said " Determination" in the Federal Register, the suspension of of f-site right-of-way clearing and construction of the Juniata transmission line dealt with in tna referenced order of February 7, 1972, is rescinded; provided, however, that if a timely request for a hearing is filed pursuant to said " Determination," the effectiveness of this Order will be stayed pending appropriate disposition of such request.
Pending completion of the full NEPA review, the holders of Construction Permits No. CPPR-40 and CPPR-66 may proceed with construction of the Juniata transmission line at thei r own risk.
This Order does not preclude the Commission, upon completion of i ts NEPA environmental review, from continuing,
