In ALAB-509, 8 NRC (1978), the Appeal Board in the above captioned proceeding invited any party who disacreed with the "de minimis" approach adopted by the Licensing Board in Perkins (Duke Power Company (Perkins Nuclear Station, Units 1, 2 and 3), LBP-78-25, 8 NRC 87, 100) with respect to the health effects attributable to 790419D065-d?.1

On February 19, 1979, Dr. Chauncey Kepford filed a brief on behalf of the Intervenors herein responding to ALAB-509 and criticizing the de minimis approach.

Under the terms of ALAB-509 and of the Memorandum and Order of the Appeal Board dated March 1, 1979, the brief of any party to the Three Mile Island proceeding in response to Dr. Eepford's brief and in support of the de minimis approach is due today.

As you know, we are counsel to the Applicants in the Tyrone proceeding (Northern States Power Company et al. (Tyrone Energy Park, Unit 1), Docket No. STN 50-484) as well as to the Applicants herein.

We have prepared and are filing today a brief in response to ALAB-509 on behalf of the Tyrone Applicants.

Our brief in the Tyrone docket addresses, inter alia, the de minimis approach issue and responds to the criticisms to that approach expressed by Dr. Kepford and by the Intervenors in other proceedings.

Please be advised that the Three Mile Island Applicants fully endorse the response of the Tyrone Applicants on the de minimis approach.

Therefore, instead of filing a separate brief on the subject, Applicants adopt and incorporate by refercnce herein those pottions of the Tyrone Applicants' brief addressing the de minimis issue.

A copy of the Tyrone Applicants' brief is being served, together with this letter, upon the percons on the attachdd Service List.
