Concurrine Cpinion of Mr. Sharfman:
I join in the decision of the Scard to defer -
sideration of the merits of the motion until disposition of the appeal and in = cst of its cpinion.
Ecwever, I deem it desirable to make a separate and supplanentary explanatien of my reascns for doing so.
The first questien we face is whether intervenors have shown goed cause for filing their motion late.
Their reasons are stated in che unsworn =ction papers signed by Dr. Kepford.--1/
Like my colleagues, I have concluded that they are insufficient en their face.
Unlike my colleagues, I think that intervencrs deserve an explanation of our reasons for reaching that conclusion.
Shorn of their invective, the excuses offered by Dr.
Kepford are as fellcws: He states that the engine of his auto-
=cbile failed in January 1978, that he lacked sufficient =cney

I have sc=e doubt as to whether this is wise in the case of a non-lawyer such as Dr. Kepford, who is not subject to the ethical strictures of the Ccde of Professional Responsibility or to the dis-ciplinary authority of the Bar.52-201

_5_/ It is clear that Dr. Kepford knew what the deadline was because, when he called our Secretary on Friday, March 21st, he told her that he could not meet the Monday deadline and wanted an extension until Friday, April 7th.

This story is insufficient to justify failure to meet the deadline.
What happened in January is surely not relevant to a tine pericd in March and April.
Moreover, even if Dr. Kepford hac no car at all while sojourning in Virginia between March 23rd and April 3rd, there is no reason why that should have prevented him from preparing his motion.
All that was necessary was a type-vriter and paper, not an autemcbile.
Any papers he needed to refer to should have been with him when he came to this area for the cral argument.
If they were not with him, he knew that at the time of the argument and shou;I have cb-jected then to the deadline set.
He did not do so. --6/
Finally, by the time he returned home and was confrented by a broken heating system, his tine had expired.
There-fore, any tine he might have had to spend repairing it is irrelevant.
Dr. Kepford assigns two other reascns for his tardiness.
Cne is that we " created ccnfusion by mentioning this matter in ALA3-465, but nec.lectine. to sc.ecifv any, deadline."
The other is that the transcript of the cral argument did not arrive at his hcme until April 8th.
These reasons are ecually lacking in merit.

In ALA3-465, we mentioned in a footnote that, "[a]t oral argument, intervencrs were granted leave to file a motion to recpen the record on the energency planning issue."--7/
We added that, "(s] hould such a =ction be filed, we will, of course, prcmptly consider it

This footnote was designed to inform the Licensing Scard of the possibility of a remand on another issue in the near future.
It did not mention the deadline set for the filing of the motion because there was no necessity to do so.
The dead-line clearly was not revoked.
There was nothing confusing about it, as is revealed by the fact that Dr. Kepford, in his call to us on March 31st, four days after we mailed ALA3-465 to his temporary Virginia address, shewed that he understccd that the deadline still applied and that he needed an extension of time.
Moreover, there is no shewing by Dr. Kepford as to why he needed the transcript of cral argument in order to prepare his motien papers.
He was the only advocate who discussed his motion at the argument.
What he knew at the argument he knew thereafter.

The question, then, is why we should censider the action at all.
To say, as does the majority, that we should do se because the =ction "is addressed to an important safety question" is not sufficient.
It is entirely possible to have an insubstantial =ction addressed to a substantial question.
It seems to me that the correct critarien was set forth by us in Ver=cnt Yankee Nuclear ?cteer Ccrp.
(Ver=cnt Yankee Nuclear power Station), ALAS-138, 6 AZC 520,
