NRC STAFF'S MOTION FOR RECEIPT INTO EVIDENCE THE AFFIDAVIT OF CLARENCE R. HICKEY, JR. AND LEAVE TO FILE SUPPLE.'.1ENTING PROPOSED FINDINGS On November 9,1977, the Commonwealth of Pennsylvania issued a revised 401 Certification for the Three Mile Island Nuclear Station, Unit No. 2

("TMI-2" ). The revised certification changes certain thermal effluent limitations previously imposed in the June 22, 1977 401 Certification, which had been utilized by the NRC Staff in its evaluation of environmental impacts on the Susquehanna River from the facility's thermal effluent. Accordingly, the Staff has evaluated the changes to the thermal effluent limitations to deter-mine the effect, if any, on the Staff'a original conclusions as presented in 1/

the Final Environmental Statement ("FES),- the Final Supplement of the FES 2/

(,"FSFES"),- and in the testimony of the Staff's aquatic mlogist, Clarence 3/

are set out in the accompanying affidavit of Clarence R. Hickey, Jr. The Staff moves the Atomic Safety and Licensing Board (" Board") to receive into evidence the affidavit of Mr. Hickey.

In addition, the Staff has revieweci certain portions of its " Proposed Findings of Fact and Conclusions of Law In the Form of An Initial Decision" dated August 19, 1977, to reflect the new 401 Certuication, and the Staff's updated review. Accordingly, the Staff moves the Board for leave to file the attached Supplementary Proposed Findings.
