SUMMARY

OF JULY 18, 2019, PRESUBMITTAL TELECONFERENCE WITH NEBRASKA PUBLIC POWER DISTRICT REGARDING PROPOSED EXEMPTION FROM APPENDIX J OF 10 CFR PART 50 FOR COOPER NUCLEAR STATION (EPID L-2019-LRM-0047)

On July 18, 2019, a Category 1 public meeting was held by teleconference between the U.S.

Nuclear Regulatory Commission (NRC) and Nebraska Public Power District (the licensee). The purpose of the meeting was to discuss a planned exemption request for Cooper Nuclear Station. The licensee plans to request an exemption from Appendix J, Primary Reactor Containment Leakage Testing for Water-Cooled Power Reactors, of Title 10 of the Code of Federal Regulations (10 CFR) Part 50 that would align the frequency of the Appendix J Option B testing with the frequency of the testing performed for the inservice testing (IST) program in accordance with 10 CFR 50.55a(f), Preservice and inservice testing requirements.

The meeting notice and agenda, dated July 8, 2019, are available in the NRCs Agencywide Documents Access and Management System (ADAMS) at Accession No. ML19189A200. A list of meeting attendees is enclosed.

During the meeting, the licensee presented information describing the current testing it performs for the IST and 10 CFR Appendix J testing programs, and discussed its planned exemption request. The presentation slides can be found in ADAMS at Accession No. ML19196A345.

The NRC staff queried the licensee throughout the presentation and provided feedback concerning the appropriateness of an exemption request versus a license amendment request in this case. Specifically, the staff informed the licensee about the change process provisions in 10 CFR Appendix J, as a possible regulatory option to consider in lieu of an exemption request, depending on the licensees specific situation. The licensee indicated that it would review the regulation and consider this option, if applicable.

No regulatory decisions were made at this meeting. No members of the public participated in the meeting. Public Meeting Feedback forms were not received.
