ACKNOWLEDGEMENT OF RECEIPT OF REQUEST TO WITHDRAW REQUEST TO RESCIND CONFIRMATORY ORDER - ENTERPRISE PROJECT IDENTIFIER L-2017-LLR-0001

Dear Mr. Terry:

The U.S. Nuclear Regulatory Commission (NRC) staff has received letter number 19-027 from B. Joel Burch to John Lubinski, dated May 9, 2019 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML19134A288).

As requested, the NRC staff has ceased work regarding the rescinding of the February 15, 2000, Confirmatory Order.

It is noted, however, that there is a related task, transmitted by letter number 16-115, dated January 3, 2017 (ADAMS Accession No. ML17009A068) requesting confirmation of the conclusion that the latest fuel type does not fall under the Process Control Limits set forth in the February 15, 2000, Confirmatory Order. This task remains open in the NRC internal Web Based Licensing tracking system under the same Enterprise Project Identifier (EPID).

At the present time, the NRC staff will continue to work toward completing he remaining task.

EPID L-2017-LLR-0001 will remain OPEN. Please reference this EPID number in any future correspondence associated with this request.

Terry 2 In accordance with Title 10 of the Code of Federal Regulations, 2.390, Hearing requests, petitions to intervene, requirements for standing, and contentions, of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of the NRCs ADAMS.
