ACKNOWLEDGEMENT OF CORDERO MINING, LLC BANKRUPTCY NOTIFICATION
Dear Mr. Dunn:
This acknowledges the letter dated July 15, 2019, signed by Bruce Hokanson, Cloud Peak Energy Resources LLCs radiation safety officer (RSO), informing the U.S. Nuclear Regulatory Commission (NRC) that Cordero Mining, LLC (Cordero Mining) filed for bankruptcy under Chapter 11 in the U.S. Bankruptcy Court, District of Delaware on May 10, 2019.
Please be informed that the bankruptcy filing does not relieve Cordero Mining of its obligations to comply with NRC requirements, including those relating to the security and control of licensed material, classified material and information, decontamination and decommissioning of contaminated facilities, and the retention of personnel required by NRC requirements (e.g., the RSO, authorized users). Additionally, the NRC will continue to conduct inspections of your activities.
Please be aware that you must first properly secure, dispose of, or transfer all licensed material, and you must inform NRC of this situation. This includes, for example, if you need to close a building. The NRC licenses remain in full effect, even beyond their stated expiration date, until terminated in writing by NRC.
You may not (i) transfer control of your license without prior written NRC approval or (ii) transfer licensed material, except as authorized by NRC regulations. You should ensure that your attorney and any trustee involved in the bankruptcy proceeding are aware of these obligations.
A person must obtain an NRC license prior to taking control of licensed activities or possession of the licensed material, including any contaminated equipment or property transferred by the licensee.
Please notify us immediately if you are unable to meet any of these conditions. Also, please notify us when the bankruptcy proceeding is completed.
