Dear Ms. Román,

On June 24, 2019, the Office of Historic Preservation (OHP) received a letter from the United States Nuclear Regulatory Commission (NRC) initiating consultation with the State Historic Preservation Officer (SHPO) on the above referenced undertaking to comply with Section 106 of the National Historic Preservation Act of 1966 (as amended), and its implementing regulations at 36 CFR Part 800. The NRC is requesting SHPO review and comment on a finding of effect for the above referenced undertaking.

The NRC received a request for review and approval of the Pacific Gas and Electric Company (PG&E) license application Agency wide Documents Access and Management System (ADAMS) Accession Number ML18215A213] to renew Special Nuclear Materials (SNM)

License Number SNM-2514 for the Humboldt Bay onsite Independent Spent Fuel Storage Installation (ISFSI), for an additional 40 years. The undertaking is NRCs renewal of License Number SNM-2514 for the Humboldt Bay ISFSI.

The Humboldt Bay ISFSI is located on a small peninsula known as Buhne Pont near the coastal community of Fields Landing on the eastern shore of Humboldt Bay. The ISFSI occupies less than one acre of land within the PG&E owner-controlled area at the Humboldt Bay Power Plant, which is undergoing decommissioning currently scheduled to be completed in 2019. PG&E is authorized to receive, possess, transfer, and store spent nuclear fuel and greater than Class C process waste in the Humboldt Bay ISFSI. The current license expires on November 17, 2025. If this renewal is approved, PG&E will be allowed to continue interim storage of spent nuclear fuel at the specifically licensed ISFSI for up to a 40-year period, through November 17, 2065.

PG&E anticipates no new significant construction at the existing ISFSI and no historic properties will be affected as a result of renewing this license.

NRC staff contacted the Native American Heritage Commission (NAHC) and requested a search of the Sacred Lands file, which was negative, and requested a list of tribal entities identified by the as having ancestral ties to the APE. The NRC sent notification to the tribal entities identified by the as having ancestral ties to the APE. To date, consulting Native American tribes, groups and individuals have not expressed concern about the undertaking or provided information of known historic properties of religious and cultural tribal significance.

The NRC has determined that no historic properties listed on or eligible for listing on the National Register of Historic Places will be affected as a result of renewing this license.

Therefore, they are requesting SHPO concurrence on their finding of no historic properties affected for this undertaking. Pursuant to 36 CFR 800.4(d)(1), I do not object to a finding of no historic properties affected for this undertaking.

Be advised that under certain circumstances, such as unanticipated discovery or a change in project description, the Corps may have additional future responsibilities for this undertaking under 36 CFR Part 800.
